we purchased an item over the internet. This item did not arrive, so 2 weeks later my husband canceled the order. He requested a refund they said that they would organise this this went on for several months, We eventually spoke to the assistant manager who promised he would help - 3 months on still nothing. They are ignoring our emails and the staff on the phone are rude. When I called last I was told its not a lot of money! We feel that this company had no intentions of refunding this money due to their attitude and the fact that they do not return calls or emails

Chest Freezer, bought 30/07/07, showed RED warning light mid Oct. 2009. Intial response from service dept. Comet: out of warranty. Quoted Sale of Goods Act 1979 (as amended) in writing, handed letter into London Romford branch (where freezer was bought and emailed copy as attchment to Comet HQ in Hull. - Was advised by Comet to book emgineer call out, had to pay £ 29.36 when booking appointment, i.e. in advance. - Engineer attended, inspected and declared freezer BER = beyond exconomical repair. Comet offered £ 120.00 = abt 2/3rd of sales price but categorically refuses to refund £ 29.36. Latest answer from Comet: "... wea re not obliged to refund your inspection fee under this legislation, as we have no evidence to suggest that the cause of the fault was due to a manufacturing defect." I am persuing a principal here: Comet intially and still trying very hard to mislead the genreal public by initially rejecting the claim alltogether (out of 1 year warranty), only reacting (positivly) with part refund under 6 year rule but still trying to reject claim for "out of pocket expenses" suffered due to manufactuing fault. Would like to "throw at them" case law, i.e. judgements as near as possible to above scenario. Thank you for your help. Lutz Friedhoff | ||||||||||

On Friday, 27th February 2009, i went into the lakeside branch to return or exchange an item i had earlier purchased. As the time had lapsed for a full refund, i spoke to a member of staff who suggested i look for an item to exchange it for. I chose a belt. The belt was 10p cheaper than the top i was returning. I told the counter staff that i was not interested in the 10p and if the could just find a way to swap it so i could be on my merry way. He responded that he could not to which i replied that surely, someone had the discretion to override the system or put it in as a manual transaction. He replied that there was not. i then asked for a credit note and he stated that the store does not issue credit notes. He stated that the only way was to buy a £1 item. to which i replied that i did not see any reason to spend an additional 90p because of 10p. He then asked me to move to one side and started serving other customers. I waited patiently for over 10 minutes and then asked him why he chose to ignore me, to which he replied that he had given me my option which was to buy a £1 item. I kept quiet until a customer came upto the till who had the same problem as me in that she was buying something lower than the vouchers she actually had. She said to them she did not want to the change and right beside me they overrode the system for her. At this point, i spoke to the guy again and asked him why he would override the system for her and not for me and that was when one of the managers on that day butted in and said i was disrupting the store and i should get out of the store or she would throw me out. Note that at this point there were only a few customers in the store. I replied that they had to attend to me as i had been there a long time and i still had the item i wanted to return. Then, another manager called the security guard to throw me out of the store. (both managers were white and female, although one looked as if she was from one of the EU states). When she said that, i moved away from the counter and told them to look at me, since they did not notice i was pregnant (i was 4 months pregnant and showing). They ignored me, started shouting at me and called the security guard. He came over to me and then i called the police. I had just been verbally assaulted, i was in fear of being physically assaulted and i had started to feel ill. A police officer did come over, and he then persuaded me because of the state i was in to pay the £1 so i could take care of myself. I did as he asked but i did lodge a complaint. I emailed my complaint to Amy but she has indirectly said that nothing would be done because of the length of time i took to complain and has stated that i was responsible. I do not know how a petite 5"4 inches pregnant woman who also suffers from a serious medical condition can have warranted such a treatment. I am making this complaint now having had my baby, recovered from a very serious illness and strong enough to deal with this issue. Not only was i verbally abused, i was racially discriminated against, humiliated and very nearly physically abused for asking for my statutory rights. I was a very regular shopper at zara but now i can't even enter the store and wouldn't want to. | ||||||||||
